Abstract
Mr. Loucks will discuss some of the highlights from the 2023-2024 United States Supreme Court term with an emphasis on the treatment of precedent decisions. The precedent discussion will focus on three of the major decisions from this term. Specifically, he will begin with the Loper Bright decision, which overruled the prior 1984 Chevron decision which set forth the legal test used when U.S. federal courts must defer to a government agency's interpretation of a law or statute. We will then contrast how the Court modified precedent in a different way in the 2024 South Carolina redistricting decision. He will conclude the discussion of precedent with a quick reference to the 2024 Jarkesy decision, which invalidated the ability of the Securities and Exchange Commission to adjudicate fines and penalties through its administrative process. Finally, he will discuss the Donald Trump Presidential Immunity decision and some of the implications of the decision for the pending indictments and for future relations between the presidency and the judiciary and Congress.
